1. General provisions

1.1.This User Agreement (the “Agreement”) is a public offer in accordance with Article 437 of the Civil Code of the Russian Federation. It is offered by the administration of taburetka.fun (the “Administration”) to any person who uses the Service (the “User”).

1.2.Acceptance of the Agreement is the registration of an Account, payment for any of the Services or activation of a Key, whichever occurs first. From the moment of acceptance, the Agreement is deemed concluded (clause 3 of Article 438 of the Civil Code of the Russian Federation).

1.3.The Rules of Service are an integral part of the Agreement. The procedure for processing personal data is described in the Privacy Policy. The User gives consent to the processing of personal data separately, under a separate document.

1.4.Persons under 18 use the Service and pay for the Services with the consent of their parents or other legal representatives.

1.5.If the User does not agree with the Agreement in whole or in part, the User must stop using the Service.

2. Definitions

2.1.The following terms are used in the Agreement:

  • Site — the taburetka.fun website and its subdomains;
  • Client — the Taburetka Client program, a modification (client) for the game Minecraft in the versions listed on the Site;
  • Loader — the program for downloading, updating and launching the Client;
  • Service — the Site, the Client, the Loader and the account page, as well as the related servers and features;
  • Account — the User’s account on the Site;
  • Subscription — the right to use the Client for the paid term: 30 days, 90 days or with no time limit (“Lifetime”);
  • Key — an activation code in the format TABURETKA-XXXX-XXXX-XXXX-XXXX that credits a Subscription or an HWID Reset when entered on the account page;
  • HWID — the hardware identifier of the computer to which the Subscription is bound;
  • HWID Reset — unbinding the Subscription from a computer so that it can be bound to another one;
  • Services — the Subscription and the HWID Reset, which the Administration provides for a fee.

3. Subject of the Agreement

3.1.The Administration grants the User access to the Service and, for the duration of the Subscription, the right to use the Client under a simple (non-exclusive) license: for personal non-commercial purposes, by launching it through the Loader on the computer to which the Subscription is bound.

3.2.Registering an Account and using the Site are free of charge. The list, terms and prices of the Services are given on the Pricing page.

3.3.The exclusive rights to the Client, the Loader, the Site and their elements — code, design, texts and graphics — belong to the Administration or its licensors. The User receives only the right to use them within the limits of the Agreement.

3.4.Minecraft is a trademark of Mojang AB. The Service is not affiliated with or endorsed by Mojang AB or Microsoft.

4. Account

4.1.To register, the User provides a login, an email address and a password and confirms the email address with the code sent to it. The address must be valid: it is needed to restore access and to communicate with the User.

4.2.One Account belongs to one person. Transferring, selling or renting out an Account and using another person’s Account are prohibited.

4.3.The User is responsible for keeping their login and password secure and for actions performed under their Account. Any suspected hacking of the Account must be reported to the Administration immediately.

4.4.The Administration may refuse registration or block an Account whose login violates the Rules.

5. Subscription, Keys and HWID

5.1.The Subscription is valid from the moment it is credited to the Account — after payment or activation of a Key. If the User already has an active Subscription, the new term is added to the remaining one.

5.2.The “Lifetime” Subscription is valid with no time limit — for as long as the Administration supports the operation of the Client.

5.3.The Subscription is bound to the computer (HWID) on which the Client was first launched. The Subscription is transferred to another computer by means of an HWID Reset; the term of the Subscription does not change.

5.4.A Key can be activated only once. Until activation, the User is responsible for keeping the Key safe. The Administration is not responsible for Keys obtained from anyone other than the Administration or its official partners.

5.5.The Administration may release Client updates, change and add features, add support for new versions of Minecraft and discontinue support for outdated ones.

5.6.The Service may be interrupted during updates and maintenance. The operation of individual features on specific game servers is not guaranteed: servers may change their rules and protection.

6. Payment

6.1.The prices of the Services are given on the Pricing page in Russian rubles. The Administration may change the prices; a change does not affect Services that have already been paid for.

6.2.Payment is made by non-cash means through the payment providers listed on the payment page. Bank card data is processed by the payment provider — the Administration neither receives nor stores it.

6.3.A contract for the provision of any of the Services is deemed concluded at the moment of payment. Payment is confirmed by a receipt or a notification from the payment provider.

6.4.A promo code gives a discount on the terms stated when it is issued and cannot be exchanged for money.

7. Provision of the Services

7.1.After payment, the purchased Services are credited to the Account automatically, usually immediately. In exceptional cases, crediting may take up to 1 working day. If they do not appear on the account page, the User needs to contact the Administration.

7.2.The Client is downloaded and launched through the Loader, which is available on the account page while the Subscription is active.

7.3.The Administration’s obligations are deemed fulfilled once the Subscription is credited to the Account, and for an HWID Reset, once the reset has been performed.

7.4.The Administration is not responsible for delays caused by incorrect data provided by the User or by failures of payment providers.

8. Refunds

8.1.The User may cancel any of the Services before it is credited to the Account and receive a full refund of the amount paid.

8.2.Once the Subscription has been credited, the money paid for it is refunded if all of the following conditions are met:

  • the Client has never launched successfully on the User’s computer, as verified against the launch records on the Service’s servers;
  • the User contacted support and did not refuse assistance, but the Administration was unable to resolve the problem;
  • the refund request was sent within 7 days of payment.

8.3.A completed HWID Reset is non-refundable: it is rendered in full at the moment of the reset.

8.4.If the Account is blocked for violating the Agreement or the Rules, the money paid for the Services is not refunded, except where a refund is required by law.

8.5.The following are not considered defects of the Services: bans of game accounts and other penalties imposed by game servers; changes to server protection that temporarily stop individual features from working; incompatibility of the Client with third-party programs and mods; the User’s computer not meeting the requirements of Minecraft and the Client.

8.6.A refund request is sent to admin@taburetka.fun from the Account’s email address. It must state the login and the date and amount of the payment and describe the problem. The Administration reviews the request within 10 days of receipt. The money is refunded by the same method that was used for payment; the time it takes to arrive depends on the bank and the payment provider.

8.7.This section does not limit the User’s rights under consumer protection legislation.

9. Rights and obligations of the parties

9.1.The User undertakes to:

  • comply with the Agreement and the Rules;
  • provide accurate information when registering and paying;
  • not give third parties access to the Account, the Subscription or the Client;
  • not take actions that disrupt the operation of the Service.

9.2.The Administration undertakes to:

  • provide the paid Services on the terms of the Agreement;
  • respond to Users’ requests;
  • process personal data in accordance with the Privacy Policy.

9.3.The Administration may restrict or block access to the Account and the Services in the event of a violation of the Agreement or the Rules, in the manner described in the Rules.

9.4.The Administration may engage third parties to perform the Agreement while remaining responsible to the User.

10. Liability

10.1.The Service is provided “as is”. The Administration does not guarantee that the Client will work on any hardware or on any game server and is not responsible if the Service does not meet the User’s expectations.

10.2.The Client runs only on the User’s computer and under the User’s control, changes only how the game works on that computer, contains no malicious code and is not intended for unauthorized access to computer information belonging to others.

10.3.The Administration does not encourage anyone to violate the rules of Mojang, Microsoft or game servers. The User assesses the risks independently and is responsible for the consequences of using the Client, including bans of game accounts and loss of in-game items and access to servers.

10.4.The Administration is not liable for the User’s lost profits or indirect losses, or for failures caused by third parties: hosting providers, payment providers, game servers and telecom providers.

10.5.The parties are released from liability if failure to perform their obligations is caused by force majeure.

10.6.The limitations of liability in this section do not apply where the law does not allow them.

11. Term of the Agreement

11.1.The Agreement is valid from the moment of acceptance until the Account is deleted.

11.2.The User may stop using the Service at any time and request deletion of the Account by writing to admin@taburetka.fun from the Account’s email address. Deleting the Account also terminates the Subscription.

12. Changes to the Agreement

12.1.The Administration may amend the Agreement. The new revision is published on this page with its date and takes effect upon publication.

12.2.Amendments do not worsen the terms of Services paid for before the amendments take effect.

12.3.If the User continues to use the Service after the amendments, the User accepts the new revision of the Agreement.

13. Claims and disputes

13.1.Claims are sent to admin@taburetka.fun. The Administration responds to them within 10 working days of receipt and reviews refund requests within the period specified in Section 8.

13.2.Disputes are resolved through negotiation and, if no agreement is reached, in court in the manner prescribed by the legislation of the Russian Federation.

13.3.The Agreement is governed by the law of the Russian Federation.
